Alchemy Shores is seeking to open a waterfront private and public event space called Alchemy Shore House located at 3780 Hoover Road Hamburg NY. This is an extension of Alchemy Wine & Beer in the Village of Hamburg. We are pursuing this project to enhance the Town of Hamburg by offering unique event opportunities as well as provide access to the waterfront; all of which align with the Towns current Comprehensive Plan. We are in no way here to disrupt the neighborhood or hinder preservation of the shoreline as that would not only be morally wrong but is not conducive to good business. We are committed to preserving the Lake, having a positive community impact, investing financially in the Town of Hamburg and working in partnership with the community.
This is bigger than just us. Its about the hundreds of solopreneurs, creators and performers that can thrive here as a safe launching space to serve the South Towns community. By supporting public access at this site you support small business operators in Hamburg.
Permitted MU1 Zoning Uses
The rezoning of M2 zoned lands to MU1 is based on the general uses proposed by the applicant (and to be operated by the applicant) but are limited to the following uses based on potential impacts: the adaptive reuse of the existing building and other improvements to the site to allow for future principal use as a private event facility. The event facility and site will have the capacity to host the following:
a.Private event space for personal occasions, such as: wedding ceremonies/receptions, showers, celebrations of life, birthdays, graduations, reunions, etc.…
b. retail sales, storage of products, tasting areas and indoor alcohol use during approved private events
c.Water-related, non-motorized, recreational rentals, such as: paddle boards, kayaks, wind surfing, kiteboarding, etc. (no docking facilities are being proposed).
d.Outdoor athletic activities (involving no motorized equipment) such as stand up paddle board yoga, rise-and-shine waterfront yoga, bocce ball, volleyball, corn-hole and other novelty league games ( in accordance with other outdoor use restrictions)
e.Other seasonal outdoor activities, seating and ceremonies for up to 175 people, including staff, at the site.
Mixed interpretation of whether these activities are “open to the public”. We feel they are!
How we have compromised
The following conditions have been placed on the site....

The Main Issue:
The confusion stems from the removal of “no outdoor alcohol facilities” and “This use is not a bar that is open to the general public” from the rezoning approval resolution. We the applicant believe this strike was done with the intention to serve alcohol outdoors and to host public events under the uses listed in C, D and E.
There are some interpretations of the resolution as there being no public events allowed AND no outdoor alcohol sales (as it is not listed as an allowable use). There are some interpretations that no outdoor alcohol vending is allowed, but that do believe outdoor alcohol use is allowed and customers who are on the site for events can consume alcohol and walk around on the beach/play volleyball/etc. The language of the resolution is confusing and what has put us in this position. We are seeking a clear interpretation that allow outdoor alcohol use at events and for the approved activities/uses at the site.

2:19:13 : Councilmember Connley proposes the amendments to strike out: " no outdoor alcohol facilities. This use is not a bar that is open to the public". It was voted 5-0 to remove that language as well as amending 10:30 pm closing time to 11:00pm.
2:33:40 : Applicant Nicole Casell says " Thank you for removing that language. These are necessary to us to conduct our business in a viable way."
